Lawsuit Funding Can Be A Financial Life-Changer for Cash-Strapped Plaintiffs During Pending Litigation

An injury caused by the negligence of another can have devastating, life changing effects. Depending on the type and the severity of the injury, medical expenses may reach thousands of dollars or more, pain and suffering could last years. Some injuries put victims out of work, permanently.

Much goes into negotiating a personal injury lawsuit. An experienced attorney can even the playing field, especially when you are going up against an insurance company or large corporation. Even with an attorney’s expertise, lawsuits take time. This often creates a negative impact on a plaintiff’s financial situation. When the powerful defendants purposely cause delays in a lawsuit or drag out a legal claim, lawsuit funding can help plaintiffs gain control of ongoing financial commitments.

A lawsuit cash advance is a means of obtaining immediate cash to help pay life’s necessities – mortgage, rent, food, car payments, medical expenses, etc. – so a plaintiff can remain in a position of strength, and allow time for the their attorney to achieve the highest possible settlement. The cash advance is on a non-recourse basis; this means the funds are only repaid if, and when, the client wins the case. If the case is lost, repayment is excused.

The application is quick and easy. Once approved, a check can be available for use within 24 – 48 hours. Other benefits of litigation funding include:
  • No long approval process.
  • No upfront fees or hidden charges.
  • No monthly payments!
  • No credit checks
  • No need to be employed.

Pre-Settlement Lawsuit Funding “Need To Knows” Presented by Lawsuit Financial

Thousands of innocent victims are injured or die due to the negligence of someone else. These unfortunate events can result from an auto accident, medical malpractice, nursing home negligence, slip and fall, or product liability. Often times, the more serious the injury, the harder it will be for a plaintiff to withstand the litigation process. While insurance companies and large corporations have deep pockets to withstand a long-drawn out legal battle, plaintiffs have fewer resources especially one who is out of work or requires around-the-clock care, or one who has lost a sole bread-winner. Powerful defendants know this and will purposely deny, delay, and defend a claim in hopes that the plaintiff will accept a low-ball offer just to meet financial needs. Few plaintiffs are aware that there is a better option.

Lawsuit Financial, one of the most experienced in the legal finance industry, shares ten pre-settlement lawsuit funding “need to knows” to help financially-strapped plaintiffs.

What is pre-settlement funding? Pre-settlement funding is a cash advance that provides plaintiffs in the pending lawsuit emergency cash against the expected proceeds of their settlement.

Who can apply for pre-settlement funding? Any personal injury victim who has retained an experience attorney and has filed a personal injury lawsuit can apply for pre-settlement funding.

When should a plaintiff apply for pre-settlement funding? Typically, plaintiffs will apply for pre-settlement funding when a case is long and drawn out and there is an immediate financial need.

Why should a plaintiff apply for pre-settlement funding? A plaintiff should consider pre-settlement funding when the case is long and drawn out, the bills are piling up, and there is no other sources of cash – savings, family, friends, etc. – to tap into.

How does the funding company determine if a plaintiff can obtain pre-settlement funding? Once a plaintiff applies for pre-settlement funding, the funding company will contact the plaintiff’s attorney for case documentation. The only requirement for approval is a case with merit. If the case is deemed to have merit, funds will be awarded based on case value. There are no credit checks or employment verifications.

How long does the application and approval process take? The application takes less than five minutes to complete. Once you apply we work directly with your attorney to quickly assess the strength of the case. If the case qualifies for funding, we can wire transferred or overnight mail the funds within 24 – 48 hours. There is no credit check or employment verification, and no application fee.

How can pre-settlement funding be used? Pre-settlement funding can be used for anything the plaintiff deems fit, but is typically used to pay the essentials – medical expenses, mortgage or rent payments, tuition, auto payments, groceries, as well other necessities.

Why can’t plaintiffs apply for a traditional bank loan? Most traditional banks will not provide a loan against a lawsuit. Additionally, banks require monthly payments, credit checks, and employment verification, as well as the promise to pay back the loan whether or not the plaintiff wins the case.
When does the “lawsuit loan” have to be repaid? Once the legal proceeding is finished and a settlement has been reached, the funding company is repaid from the proceeds of the lawsuit.

What if the plaintiff loses the case? Because pre-settlement funding is provided on a non-recourse basis, if the plaintiff loses the case, the lawsuit cash advance is completely waived.
If you are in a pending personal injury lawsuit with attorney representation, you are eligible for pre-settlement lawsuit funding. Call Lawsuit Financial at (877) 377-7848 for more details or apply online. We also offer a free, no-obligation case evaluation.

Protecting Distracted Driving Accident Victims from Financial Ruin

Contrary to the negative public perception of personal injury attorneys, many of those attorneys have placed themselves squarely on the front lines in the fight against distracted driving. Personal injury attorneys advocate for safer roads and they stand up for the rights of seriously injured victims, or family member who have lost loved ones because someone was driving while distracted. But fighting for a victim's rights can take time in order to obtain the best compensation. Unfortunately, many victims are not in a financial position to wait out the litigation process. Finances can be seriously depleted as a victim tries to keep up with the bills. Due to backlogs in our court systems and deliberate delay tactics of insurance companies, some are forced to settle for pennies on the dollar.

Lawsuit funding is a service that provides needed financial assistance to seriously injured victims of negligent drivers. The strategy behind lawsuit funding is to help plaintiffs avoid feeling pressured to accept a settlement too early, for too little. In effect, it levels the playing field and buys the plaintiff time to achieve full case value. Although the cash advance can be used anyway the client chooses, typically the funds are to pay outstanding medical bills and daily costs of living, such as mortgage payments, food and other important expenses.

Unlike with a loan, plaintiffs receiving lawsuit funding do not pay upfront fees. In fact, they pay nothing until the case settles. Additionally, a legal funding company will not conduct a credit check or verify employment, because the only factor in obtaining lawsuit funding is a case with merit.

Are you in a pending lawsuit and struggling financially? To get back financial control of your life after a personal injury, check into the benefits of lawsuit funding by contacting Lawsuit Financial. The application process is quick and easy, and can be done online. Once we review your application and applicable case documentation, if approved for funding, we can have the cash in your hands within 48 hours or less.

A tour bus plowed into the back of a semi-truck on a Southern California highway over the weekend, killing 13 people, including the bus driver, and injuring at least 31 others, some critically.

The California Highway Patrol (CHP said the bus was travelling significantly faster than the truck, but it is unclear whether the bus driver was speeding. The impact pushed the trailer about 15 feet into the bus. Firefighters used ladders to climb into the bus windows to remove bodies and tow trucks lifted the trailer to make it easier to reach the bus, whose front end was demolished. It took nearly two hours to separate the vehicles.

The CHP had been slowing traffic for hours that day to allow Southern California Edison workers to string wires across Interstate 10. The bus was carrying 44 passengers who were returning from a trip to the casino. The driver was one of the owners of the bus company, which typically ferries people from LA to nearby casinos.

Investigators will be looking into the cause including whether alcohol, drugs or fatigue played a role in the crash. Records showed that the bus had been inspected in 2014, 2015 and April 2016 with no mechanical deficiencies reported. Additionally, Federal Motor Carrier Safety Administration records show the bus had a satisfactory safety rating.

The charter bus company was sued once for wrongful death and twice for personal injury claims in the past, although all three lawsuits were eventually dismissed, according to court records. The defendant succeeded in having the lawsuit dismissed in June 2009 because the plaintiffs failed to provide information sought through the discovery process in court. In addition to the lawsuits, the driver had been cited twice for speeding.

Although his death means there will be no criminal charges stemming from this accident, wrongful death lawsuits will most likely be filed against the bus driver’s estate and his company. Due to the complexity of the lawsuits, those injured and families of the deceased may be experiencing financial duress to the point where help is needed.

Lawsuit funding is available to pay the mortgage/rent, funeral expenses, utilities, groceries, and any other important bill or expense while waiting for a settlement to be reached. A lawsuit cash advance gives plaintiffs a strategic advantage by providing leverage against the insurance company so the plaintiffs avoid accepting inadequate settlement offers. The application process is quick and easy because funding is based completely on the strength and merit of the lawsuit. We do not charge application or upfront fees, nor do we need a credit check or employment verification. Additionally, there are absolutely no payments made until the case settles; if the case is lost, repayment of the cash advance is waived.

If you were injured or lost a loved one in a bus or auto accident, it is important to contact an attorney to help recover compensation for your loss. When you need help with life’s necessities, contact Lawsuit Financial. When you know your bills and expenses are covered, it is much easier to fight for justice.

Family Sues Nursing Home For Negligence Resulting In Pressure Ulcers

A lawsuit has been filed against a nursing home facility in which the plaintiff alleges negligent care caused her loved one to suffer pressure ulcers.

According to the claim, between late 2014 and early 2015, the nursing home did not adequately supervise the resident to avoid the development of pressure ulcers or provide immediate medical treatment. The plaintiff seeks judgment in an amount greater than $50,000.

Nursing home lawsuits usually take years before a settlement is reached. With bills continuously adding up, the ability to wait for a fair settlement may not be an option without the help of litigation funding. Litigation funding is a means for plaintiffs to pay medical expenses or other necessary bills as a result of injury and/or disability without worrying about jeopardizing their credit. The strategic advantage of a ‘lawsuit loan’ is that it provides the plaintiff the financial strength to await for a reasonable offer from the insurance company or defendant. That means the ability to refuse all low ball settlement offers.

This form of legal funding is not like a traditional loan, so factors such as employment history and financial standing are not required. The only concern is the validity of the lawsuit and the likelihood of its success. There are no monthly payments; repayment is made once the case settles. Additionally, the money is provided on a non-recourse basis meaning it does not have to be repaid in the event of a lost case. Once the determination has been made to provide funding, cash can be made available in as little as 24-hours. There are no restrictions on how the lawsuit cash advance is used.

If you or a loved one suffered physical or emotional injuries because a nursing home was negligent or failed to fulfill its care obligations to you and your family, you may have grounds for a nursing home negligence case. Contact an experience attorney as soon as possible. Once the lawsuit is underway, if you are feeling the pressure to settle, litigation funding can be the monetary flexibility needed to hold out for a greater settlement. Contact Lawsuit Financial at 1-877-377-SUIT (7848) to discuss your financial needs or complete our quick and easy online application.

Parachutist Falls 1,200 Feet From Plane in Florida

Authorities in central Florida have reported that a man fell to his death after his parachute deployed as he was kneeling by the jump door of a small aircraft.

According to witnesses in the plane, the reserve chute accidentally deployed and pulled the man from the aircraft. The victim hit the side of the plane and then fell some 1,200 to the ground. It is unclear at this time if the parachute fully deployed. The sheriff's office said the man was an experienced jumpmaster, someone who helps train others in military jumping techniques. He was with a group doing military-style parachuting at the time of the incident. An investigation is underway.

If investigators determine that this accident resulted from defective equipment or negligence on the part of another, the family of the deceased may have a viable case for a wrongful death lawsuit. A case such as this could take years before a verdict or settlement is reached. Insurance companies love to prolong claims to force the plaintiff to settle for much less than they deserve. A plaintiff that is financially strapped, especially those who lost the family bread-winner, will often accept such an offer just to maintain financial stability. A better option would be to apply for pre-settlement lawsuit funding, money given in advance of an expected settlement or jury verdict to pay the mortgage, car payments, funeral expenses and other necessary expenses especially when the death results in a significant loss of income.

Pre-settlement lawsuit funding is easy to apply for, requires no credit check or employment history, no upfront fees, and no monthly payments. All that is important is that the applicant has attorney representation and a strong case. Once a case is approved for funding, the cash advance can be available within 24-48 hours.

Lawsuit funding is contingent upon the outcome of the case. If the case is successful, Lawsuit Financial is repaid from the proceeds of the case. If the case fails, the repayment is waived.

Call our office at 1-877-377-SUIT to learn how pre-settlement funding can keep you financially stable and increase the value of your case. We offer free, no-obligation consultations. If you are ready to apply, our online funding application takes just a few minutes to complete.

Drunk Driver Arrested After Running Up On Sidewalk, Running Down Two Pedestrians

A woman has been arrested on DUI charges after Arlington County police said she ran over two pedestrians.

After an initial investigation, police determined that the woman had driven onto the sidewalk "striking a pedestrian in the crosswalk and knocking down a light pole." She continued down the sidewalk and struck a second pedestrian, trapping that pedestrian under the vehicle. The first pedestrian was taken the hospital and treated for minor injuries; the second pedestrian is being treated for serious, but non-life-threatening injuries.
In addition to the DUI charges, the negligent driver may also face lawsuits from the injured victims. If they file a lawsuit and are struggling to pay the bills, they may find financial assistance in the form of a lawsuit cash advance, known as lawsuit funding.
Lawsuit Financial is a direct lender for pre-settlement lawsuit funding. A lawsuit cash advance provides the cash plaintiffs need to pay medical bills, living expenses and other financial obligations while pursuing a settlement. There are no upfront fees, no monthly payments and no risk. The only requirement is a pending lawsuit with merit and a serious financial need. Funding is provided on a non-recourse basis, so if the plaintiff loses the case, there is no obligation to pay us back. Repayment is only made when the case is won. With our quick and easy application process, cash can often be available in less than 48 hours after receipt of a completed application. There are absolutely no restrictions on how the money is spent.
If you have been seriously injured due to the negligence of someone else, are seeking restitution, and need financial assistance, call Lawsuit Financial at 1-877-377-7848 or complete our online funding application. We may be able to help you defray expenses during a pending claim rather than risking your credit with mounting, unpaid bills or settling for less than you deserve.

Mother Dies in Hit-and-Run Accident While Saving Her 7-Year-Old Daughter

A Connecticut woman saved her 7-year-old daughter’s life by pushing her out of the way moments before being struck and killed herself by a hit-and-run driver.

The young girl told police that she and her mother were crossing the street and nothing was coming. Suddenly, her mother saw an approaching vehicle and pushed her to safety. The impact pushed the woman partially underneath a parked SUV. The child ran home for help. A neighbor called police after finding the woman unresponsive under the vehicle. The woman was taken to the hospital, where she died a few hours later from head and neck injuries. Her daughter was hospitalized with minor injuries and has since been released. The driver fled the scene.

Police are searching for the hit-and-run driver, who may be driving a dark-colored Nissan with a missing side mirror and casing, which was found at the scene. Anyone with information is asked to Lt. Thomas Cossette or Officer Mark Gibbs at 203-630-6215.

There can be nothing worse than to be seriously injured or lose a loved one due to an at-fault driver who failed to stop after the accident and then disappeared. Hopefully the authorities will find the person responsible for this tragic accident. Even then, charges against the hit-and-run driver does little for this young child who not only lost her mother, but witness the terrible tragedy. Not only will there be a financial impact such as medical bills, funeral and burial expenses, and lost wages, but this little girl most likely will face emotional and psychological trauma.

Determining fault can sometimes be a complicated process. Was the driver speeding, intoxicated or distracted in some way? Did the woman fail to look before attempting to cross the street? Could either person have avoided the accident?

A wrongful death attorney can ensure that the family's rights are protected and decide the best course of action in recovering the maximum compensation for funeral and burial expenses, anticipated and future lifetime earnings, loss of love, care and companionship, and other damages related to this pedestrian accident.

While the family may eventually receive a financial settlement to compensate them for their loss, they may experience significant financial hardship in the interim. During the litigation process, they may find that lawsuit funding can help ease the financial burden until a settlement or verdict is achieved.

Lawsuit funding is financial assistance in advance of an expected settlement or verdict. The only eligibility requirements for funding are attorney representation and a strong case. There are no application fees, credit checks, employment history verifications, or monthly payments. Once an application is completed (which takes 5 minutes or less) and case documentation received, our underwriters will review the case for funding. If approved, we can wire transfer or overnight mail the cash advance within 24 – 48 hours. The money can be used to help cover medical expenses, household bills or anything the plaintiff wishes. We do not restrict how the money is used. Repayment is only made when a settlement is reached. If the case is lost, there is no obligation on the part of the plaintiff to repay the cash advance.

If you suffered serious injury or lost a loved one in a pedestrian-auto accident and awaiting justice, don’t let your bills wait and ruin your credit. Allow Lawsuit Financial to help you during this time so you can seek justice for your loved one. Call our office or visit us online for more information or to complete a funding application.

Lawsuit Financial Offers Financial Stability In Medical Malpractice Wrongful Death Cases

When a doctor does not provide proper treatment it can lead to serious complications or the death of the patient. Victims of medical malpractice or their families may be able to file a lawsuit against the doctor and/or hospital, seeking compensation for medical expenses, funeral and burial expenses, lost wages, pain and suffering, and other damages. Once a lawsuit is filed, those suffering financially can apply for litigation funding.

The family of a deceased man recently filed a medical malpractice lawsuit against a doctor and medical facility claiming negligence resulted in the death of their loved one. According to the suit, after the man went to the hospital seeking medical treatment, doctors failed to request cardiac testing and therefore failed to diagnose a serious heart condition. The patient was discharged with no instructions or further medical attention given. He later suffered a heart attack and died. The lawsuit alleges that the doctor’s negligence caused the man’s heart condition to go undiagnosed and untreated, ultimately leading to his death.

Given the nature of this situation, a possible wrongful death involving a medical error or misdiagnosis, it may take years before the case goes to court and/or culminates in a settlement or award. No one has limitless financial strength. Plaintiffs often face financial hardship trying to make ends meet with ordinary cost of living expenses, medical expenses, funeral expenses, and the loss of income. When this happens, litigation funding may be a viable solution.

Litigation funding is a cash advance against the future settlement of the case, often be approved within 24 – 48 hours. It helps a plaintiff remain in a case longer in order to pursue a larger, more favorable settlement. There are no up-front fees or monthly payments and no credit checks or employment verification. Best of all, repayment is contingent on the outcome of the lawsuit. If the case is lost, repayment of the cash advance is completely waived. Although there are no restrictions as to how the money is used, litigation funding should be used sparingly and wisely. It should be used to pay for life’s necessities such as food, medical bills, mortgage payments and other important daily expenses that become difficult due to serious injury, disability or death.

Were you or a loved one the victim of medical negligence? Pain and suffering, emotional stress, and loss of income are only a few of the reasons you may be able to file a medical negligence claim. An attorney can help determine if you have a winnable case and help you seek the compensation you deserve. After filing a lawsuit, if you need financial assistance while waiting for justice to be served, contact a Lawsuit Financial to discuss your case funding situation.

Investigators Say Trucker Fatigue and Meth Use Likely Cause of Crash That Left Six Dead

Fatigued driving has become an epidemic. Those most likely to drive while drowsy or fatigued are commercial truck drivers, cab drivers, and late-night shift workers.

A crash on a Tennessee highway that left six people dead last year was probably due to a fatigued truck driver who had taken methamphetamine to stay awake, according to a recent report by federal investigators.

On June 25, 2015, a tractor trailer failed to slow down in a construction zone and plowed into multiple vehicles on Interstate 75, killing six and injuring six others. Investigators said the trucker was traveling approximately 80 mph despite ample warnings that he was approaching a construction zone with a 55-mph limit. There was no indication of heavy braking or that he tried to take evasive action before causing the crash.

The National Transportation Safety Board (NTSB) also cited a failure in the trucking company’s employee screening process which would have shown that the driver had been fired from a previous trucking job two years earlier because of illegal drug use. The trucker even tested positive for meth less than three months prior to the crash, under a separate court order. The agency also found that the truck driver had likely gone without sustained rest for 40 hours before the crash. He was indicted on six counts of vehicular homicide, four counts of reckless aggravated assault, driving under the influence of narcotics, speeding and making false reports about his duty status.

At least two lawsuits have been filed against the truck driver and his employer alleging that the crash happened as a result of “their reckless and grossly negligent actions.” The complaints also allege that the trucker had a pattern of dangerous behavior prior to the deadly crash. Just a day prior, he was cited for careless driving in Florida after sideswiping another truck. Additionally, he did not submit a drug test after the Florida crash, a requirement under the Federal Motor Carrier Association, according to the claims.

While the lawsuits will help compensated victims for their loss, attorneys for the plaintiffs hope these claims will enforce stricter guidelines involving commercial truck drivers, so that such a tragic crash does not happen again. That will surely take time, just as it will to achieve a settlement in these cases.

The financial strain during times like this not only seriously impacts your life, it also impacts your case. A financially desperate plaintiff is not in a favorable position regarding settlement negotiations. If you are in need of a cash flow solution during the litigation process, lawsuit funding may be a viable option.

Lawsuit Financial Corporation helps provide legal finance cash flow solutions and consulting when necessities of life litigation funding is needed by plaintiffs involved in pending, personal injury litigation. Two Teens Killed In Route to School When Drunk Driver Slams Into Their Vehicle Head-On

An auto accident claimed the lives of two teens when their vehicle was hit head-on as they drove to school. According to the North Carolina Highway Patrol, the driver of a Pontiac Grand Prix crossed the center line colliding with the teen’s Chevrolet Sonic. The Grand Prix caught on fire, but the driver was able to escape with non-life threatening injuries. While speed was not a factor in the accident, the driver of the Pontiac has been charged with a DWI and other charges on the driver are pending.
Injuries and deaths caused by a driving under the influence are often the subject of civil suits. While the negligent driver can face serious criminal charges, he/she can also face civil liability.
An injured victim of the family of a lost loved on should consult an experienced auto accident attorney to hold the negligent party accountable and to seek compensation for damages. If a lengthy legal process hinders the families from paying the bills associated with the crash, or even ordinary living expenses, auto accident litigation funding may be a valuable service.

When Your Case Takes Too Long, Auto Accident Lawsuit Funding To the Rescue

Every lawsuit is totally different. Some will settle in a few months to settle while others may take several years depending on the issues involved in the case and the extent of the victim’s injuries. While some plaintiffs may understand that justice takes time, they are rarely prepared for a lengthy litigation process, especially when the defendant’s insurance company purposely delays, using every legal trick in the book to limit the plaintiff’s settlement. This is a common tactic to put pressure on a plaintiff who are struggling financially. After delays, they will offer a low settlement amount, hoping the plaintiff will feel forced to accept rather than waiting for the larger settlement deserved.

Although you may need the money and prefer to settle your case as quickly as possible, you do not want to get “shorted” on the compensation your rightfully deserve. Resist the temptation of quick money to ensure that you receive every penny you are entitled. A risk-free way of doing this is with lawsuit funding.

Lawsuit funding is a simple solution to help plaintiffs get back on their feet financially, so that they can pay their bills, buy groceries and live comfortably while awaiting settlement. Once a plaintiff is represented by and attorney and the lawsuit has been filed, it is time to consider one’s financial situation. Auto accident lawsuit funding is an emergency cash advance for plaintiffs who need to pay the bills during a lengthy litigation. In fact, it may be the only financially sound way to fight the insurance company deny, delay and defend tactics.

What is required to qualify for a lawsuit cash advance? All you need is attorney representation and a strong case. After completing a funding application, your attorney will provide the information necessary to determine if your case is approved and for how much. Credit checks and employment status do not matter. There are no upfront fees or monthly payments. You only repay the money once you settle your case, at which time your attorney will pay us from the case proceeds. So, no money ever directly leaves your pocket. Auto accident lawsuit funding is provided on a non-recourse basis, meaning if you fail to win your case, you are not required to repay the advance.

Have you been injured in a car accident, and now find it impossible to pay the bills? Call Lawsuit Financial toll free at 1-877-377-SUIT (7848) or visit us online to if you would like to apply for lawsuit funding or wish to simple request additional information.
