Victims Have the Power to Seek Justice with Pre-Settlement Lawsuit Funding

A Kansas woman was apparently electrocuted after a single-vehicle auto accident.  When the 26-year-old woman lost control of her vehicle, the car struck a utility pole.  Witnesses said when the woman got out of the vehicle, a power line came down; they saw arching and heard explosions.  She was unresponsive at the scene and pronounced dead at a local hospital.  Her two young children in the backseat were unharmed.  An investigation is ongoing to determine what may have caused the woman to lose control and the vehicle to leave the road.
Was the driver distracted? Was there a mechanical failure or defect? While all the details of this fatal auto accident won’t be known until the investigation is complete, witnesses said that the despite this being the first fatality in the area, it is not the first time the pole has been struck by drivers. They believe the intersection is dangerous because of the way the road splits; if a driver misjudges the curve, they could very well hit the pole.  Residents are pushing to move the pole back a few feet.
Safety officials say people should always assume the lines are hot and dangerous so it is best to stay in the vehicle and wait for help.  Getting out might allow the electricity to ground from the car through you. If you see someone in a vehicle with downed power lines on it, do not touch the car or try to rescue the person inside as you could be electrocuted.  If you must get out of the vehicle, jump or hop away to avoid touching the vehicle and the ground at the same time, and keep feet together.  Never attempt to move the lines or touch anything that is touching the line.

Although the driver may have been driving carelessly, failure to avoid foreseeable events from turning tragic is a form of negligence.  When a roadway is poorly designed or road signs, poles, and barriers poorly placed, it can cause or contribute to an auto accident and require an extensive investigation of the roadway and its history. This is especially critical when the roadway has been the site of previous accidents.

No matter how this investigation concludes, the family should seek legal advice from an experienced attorney as soon as possible. They may be able to receive compensation for the wrongful death of their loved one and claim damages for pain and suffering, lost wages, medical bills, and other damages. A wrongful death attorney will help determine if a government entity was responsible for failing to fulfill its obligations of making sure the road is somewhat forgiving of driver error, if the automobile manufacturer was responsible for a defective part that caused the woman to lose control, and/or if the accident was due to drive negligence. Nonetheless, it will be a long legal process and difficult to prove, but with the help of an experienced auto accident attorney, the victims’ family can fight for justice and compensation for their loss.  During this time, the family may be unable to pay funeral and burial expenses, and the costly needs of the deceased two small children.  A financially desperate plaintiff is not in a favorable position regarding settlement negotiations; this person will often settle for too little, too soon. One option to surviving financially while waiting for a settlement is lawsuit funding.

There are no costs or fees associated with a funding application. If approved, funds would arrive within 24 – 48 hours by check or wire.  There are no monthly payments, credit checks, or employment verification, and repayment is contingent upon the outcome of the case.  If the plaintiff loses, the lawsuit cash advance is waived in its entirety.

When Lawsuit Financial is able to provide the freedom to wait for the highest possible settlement there is not need to accept less than full case value. Applying for lawsuit funding can be done online or by calling one of our funding specialists who will happily explain the funding process and review the details of your case to determine your eligibility.

When A Dog Just Won’t Let Go The Consequences Can Be Serious or Fatal

Pit bulls are known to be friendly and docile one minute, only to violently attack the next. Here are just two examples of how quickly these pets can turn on someone.

Receiving a call of a domestic dispute at an apartment complex, police discovered a pit bull had mauled its owner and the owner’s mother. Apparently the young man and his elderly mother were engaged in an argument that prompted the man’s pit bull to attack the woman. When the man tried to pry the dog from his mother, the pit bull turned on him. Police arrived after receiving a domestic dispute call and found the dog was on top of the man, biting him. Believing the only way to stop the attack, police shot and kill the pit bull. The elderly woman was taken to the hospital with bite wounds on her arm; her son was treated with more severe injuries.

A four-year-old girl is recovering after she was recently attacked by a pit bull in a Santa Monica home. The little girl, her mother, and her mother’s friend who was dog sitting returned from taking the pit bull for a walk. After the dog sitter removed the pit bull’s muzzle, the animal appeared to sniff the child before it lunged at her leg. The dog sitter broke two fingers during the attack.

Many people don’t realize that dog bite and dog attack cases may be pursued under the dog owner’s homeowners’ insurance coverage as a personal injury case. If you have been seriously injured from a dog bite or attack, it is important to consult a personal injury attorney who can help protect your rights. A victim can recover compensation for medical expenses, future medical care, disfigurement, loss of income, emotional trauma, and pain and suffering.

There is no doubt that a personal injury lawsuit, if filed in either of these cases, will take a while to resolve. If the victims are facing financial difficulties during this time, lawsuit funding may be a solution.

Strategic lawsuit funding can help pay ongoing medical bills and other important expenses, while recovering
physically and emotionally and waiting for a fair settlement. Such funding is intended to remove the financial pressure to resolve a serious personal injury lawsuit too soon, for too little due to pressing financial need. Lawsuit funding is provided on a non-recourse basis meaning the plaintiff repays the lawsuit cash advance upon settlement, but if the plaintiff loses, s/he is not required to repay the advanced funds. To obtain lawsuit funding, all that is required is legal representation and a case with merit. The application process takes less than five minutes, and once a case is approved the funds can be wired into the plaintiff’s bank account within 24 – 48 hours. It is really that simple, so don’t delay; call today!

Lawsuit Financial Carries the Financial Burden during Your Personal Injury Lawsuit

When you have been injured as a result of someone else’s negligence, the last thing you want is to worry about how you will pay the bills, especially if you are unable to work. Even if a settlement is forthcoming, the legal process will typically take longer than a financially-strapped plaintiff can withstand.  If you are struggling financially, and can’t wait months, or quite possibly years, to obtain a settlement, you may be an ideal candidate for lawsuit funding.

If you are a plaintiff faced with financial pressures and feeling motivated to accept a settlement offer well below what you deserve, consider lawsuit funding first.  This type of funding is not a loan, but a cash advance until your case settles.  The best part is that lawsuit funding is risk-free.  Repayment is only made once the case successfully settles; there is no obligation to repay if the case is lost.

“I desperately needed money to avoid eviction and pay some bills while waiting for my auto accident lawsuit to settle.  I called several banks, but they would not help since I was unemployed.  My attorney suggested lawsuit funding. Again, I made several calls.  Lawsuit Financial was willing to help and seemed like the best option.  They gave me $2,500, but three months later, I lost my case.  I was not only devastated from losing my case, but I had paid-off my bills with the money from Lawsuit Financial and had no way to pay them back.  When I called Lawsuit Financial, to explain my latest situation, Sandy told me I was not obligated to pay them back as stated in my contract.  Due to all the stress, I had completely forgotten that one reason I chose Lawsuit Financial was their payback policy.  I am sure glad I did I chose Lawsuit Financial.”  C.J.

Auto Accident Lawsuit Funding Covers Victims of Moped and Scooter Claims

While scooters and mopeds provide enjoyment, as well as a means to conveniently and inexpensively get around town, when accidents occur they can be catastrophic.  These accidents may occur if another driver is distracted or does not see the moped for other reasons such as their size.  If you are injured or lost a loved one in a moped or auto accident and need lawsuit financing until your case settles, Lawsuit Financial may have the perfect.

Two passengers on a moped were killed; the driver seriously injured when the driver of a 2010 Hyundai Accent slammed into the back of the bike before fleeing the scene.  All three teens on the bike were thrown onto the road.  A female passenger was hit by another vehicle after falling into an adjacent lane.

After identifying the hit-and-run driver, police learned she was driving on a suspended license and her driving record is marred with a list of infractions including careless driving and "driving too fast for conditions." Her license was suspended last month because she failed to obtain auto liability insurance, which had not been reinstated at the time of the accident.

The accident remains under investigation, but investigators don’t believe alcohol was a factor.  The negligent driver claims she did not see the moped.  Was she distracted, driving too fast, or negligent in another way?  Nothing is for certain until the investigation is complete.

The injured victim and the families of those who died may want to seek the advice of an experienced attorney to understand their rights.  If a lawsuit is filed, and the plaintiffs are struggling to pay the medical bills and funeral and burial expenses, a lawsuit cash advance, known as lawsuit funding may be helpful.

Lawsuit funding is a mechanism through which a plaintiff can receive emergency cash when they may not have the funds to wait months, or years, to reach a settlement.  Because funding is approved on case merit alone, there is no need for credit checks and the funding applicant does not need to be employed.  Lawsuit funding is provided on a non-recourse basis meaning the cash advance carries no risk; if the plaintiff loses the case, he/she owes nothing.

At Lawsuit Financial, we strive to streamline the funding process making it faster and easier for plaintiffs to get the money they need.   The application process takes less than five minutes.  Once our investors review a case and determine the likelihood of a favorable settlement, we can wire funds directly to our client’s account within 24 – 48 hours.  Lawsuit Financial is a leading provider of non-recourse funding solutions, so whether you are searching for pre-settlement funding against a pending claim, or post-settlement funding against a settled case, we can work for you.

Insurance Company Obstacles to Avoid Paying Claims

The case is Safeway Insurance Co. v. Hanks involved a man who was pursuing an uninsured motorist claim with his insurance company after a hit-and-run accident. Mr. Hanks claimed injuries to his head, neck, back, and leg as a result of the auto accident. A jury found in favor of the plaintiff and awarded him $13,000. Safeway appealed, alleging that the trial court erred in allowing testimony from the man’s expert. The insurance company argued that Hanks needed a medical expert to testify that the accident caused him to suffer a herniated disk in his lower back.

Although there was evidence that the man was in a prior auto accident in which he suffered similar injuries, the radiologist testified that that a significant portion of the herniated disk had cured. The evidence was sufficient to support a jury instruction on the preexisting condition, and the trial court did not err in so instructing the jury.

The Georgia Court of Appeals rejected Safeway’s argument saying that such an injury did not raise a “medical question” that required an expert’s testimony to establish causation, and it was up to the jury to determine whether if there was a connection between the accident and injuries. For example, back injuries resulting from a rear-end auto accident do not raise “medical questions” that require expert testimony on causation. The decision reinforced the principle that juries should decide issues within their common knowledge as long as some evidence has been introduced to support a claim.

If the insurance company has denied your insurance benefits after an auto accident, or if you are getting the run-around from your insurance adjuster, you should seek an experienced auto accident attorney. Suffering a personal injury from an auto accident is bad enough, but when the insurance company refuses to negotiate or settle your claim in good faith for the sole purpose of protecting its own profits, the impact to you can be devastating. Don’t be bullied by insurance company tactics. Justice will not be served; you will not receive what you deserve. Apply for lawsuit funding from Lawsuit Financial. A well-placed non-recourse lawsuit cash advance can often ease the financial pressure until your case settles.
