Designated Driver Killed by DUI Detective “Drives” Home the Impact of Drunk Driving

We all know that drunk driving can cause serious or fatal accidents. Unfortunately, it seems that even some people who are supposed to be examples of law-abiding citizens choose to ignore the laws.

A 22-year-old Long Island student went out for the evening with family and friends to celebrate her sister’s 21 birthday. As the designated driver, she consumed no alcohol during the evening. While driving her sister and her sister’s boyfriend home, their Honda Civic was rear-ended by a Mercedes traveling at a high rate of speed. The impact caused the Honda to strike a tree and utility pole. The college student was rushed to the hospital where she underwent surgery for injuries, which included a broken pelvis and severe internal damage. Sadly, she passed away the next day. A blood test confirmed that she had not been drinking. Her two passengers sustained minor injuries.

The driver of the Mercedes was an off-duty police officer who was charged with driving while intoxicated, vehicular assault, assault, and refusal to take a breath test.

Losing a loved one is a extremely difficult time, especially when the tragedy could have been prevented. In addition to any criminal charges, the victims' family may wish to hold the officer accountable through a wrongful death lawsuit. They should contact an experienced auto accident attorney as soon as possible to understand their rights and what potential causes of action they may have.

Lawsuit Financial extends our deepest sympathy to the family of the deceased woman. Although we offer litigation funding services to plaintiffs in a pending lawsuit, it is our hope that by continuing to blog about the dangers of drunk driving that someday all motorists will realize that their actions can, and do, affect others.

Just because the person who causes a crash is a police officer, does not mean he cannot be held accountable for negligent actions. Drunk driving is inexcusable for anyone. Don’t make careless decisions. Drive responsibly!

Family Settles Lawsuit for $5 Million in Wrongful Death Tractor Trailer Case

Trucking accidents cause thousands of catastrophic and devastating injuries and deaths each year, resulting in lawsuits which can often take an extended time to settle.

The family of a New Jersey woman who was killed in March 2014, when her car was struck by a tractor trailer, has reached a settlement with a trucking company for $5 million.

The settlement stems from a crash between the deceased woman and a tractor trailer driver. The woman was stopped at a red light when the tractor trailer slammed into the back of her vehicle, pushing it through the intersection. The vehicle burst into flames on impact; the woman inside was pronounced dead at the scene. According to the plaintiff’s attorney, investigators had evidence that the truck driver never attempted to brake before colliding with the victim’s car. The results of a blood test showed the truck driver was under the influence of methadone and Xanax at the time of the crash. Both drugs are classified as habit-forming that that medically disqualify commercial drivers from operating a truck. He later plead guilty to vehicular homicide in criminal court.

The trucking company, whose identity has been kept confidential per terms of the settlement agreement, agreed to pay $5 million as the results of mediation.

Moving on, the family of the deceased woman is pushing for broader legislation that would require trucking companies to test interstate truck drivers for methadone. Currently, methadone testing is optional under federal law.

Two Teens Killed In Route to School When Drunk Driver Slams Into Their Vehicle Head-On

An auto accident claimed the lives of two teens when their vehicle was hit head-on as they drove to school. According to the North Carolina Highway Patrol, the driver of a Pontiac Grand Prix crossed the center line colliding with the teen’s Chevrolet Sonic. The Grand Prix caught on fire, but the driver was able to escape with non-life threatening injuries. While speed was not a factor in the accident, the driver of the Pontiac has been charged with a DWI and other charges on the driver are pending.
Injuries and deaths caused by a driving under the influence are often the subject of civil suits. While the negligent driver can face serious criminal charges, he/she can also face civil liability.
An injured victim of the family of a lost loved on should consult an experienced auto accident attorney to hold the negligent party accountable and to seek compensation for damages. If a lengthy legal process hinders the families from paying the bills associated with the crash, or even ordinary living expenses, auto accident litigation funding may be a valuable service.

Victims of Drunk Driving Accidents Can Protect Their Assets with Litigation Funding

The selfish decision to drink and drive can change lives forever! In many cases, the offender walks away with minor injuries or no injuries and receives an insignificant punishment or is sentenced to a few months in jail. On the other hand, the victim and/or their family will struggle emotionally, physically, and financially. As if that wasn’t enough, waiting out the litigation process can be paralyzing. In times like this, auto accident litigation funding is a good option. Here is a recent tragic accident that may benefit from the legal services at Lawsuit Financial.

Two Farmington, Missouri motorcyclists were killed after a pick-up truck crossed the center line on a curve, colliding with their motorcycle head-on, according to the Missouri State Highway Patrol. The impact threw the couple from the motorcycle; they were pronounced dead at the scene. Both were wearing helmets. The truck driver was not injured. He was arrested on suspicion of driving under the influence and faces two counts of involuntary manslaughter. The crash happened at approximately 3:30 p.m. Sunday, on Highway 72 in Bollinger County.

Although it may be difficult for surviving family members to think about taking legal action following the loss of loved ones, a wrongful death lawsuit is the only way to hold the negligent party accountable for their actions and for the family to seek compensation for damages. In addition to compensation for funeral costs and other expenses resulting from the death, the family can also seek damages for the loss of present and future earnings as well as intangible elements of life, such as loss of companionship, which cannot be assigned cash value. Such cases can take months, even years to settle.

While all the precautions in the world can’t protect you against someone who consciously drinks and drives, Lawsuit Financial can protect your assets while you await a settlement or trial. Litigation funding is an emergency cash advance to assist qualified plaintiffs who are struggling to make ends meet due to injury or death caused by an auto accident. All that is required to be eligible for funding is attorney representation and a case with merit. Simply complete an online application and Lawsuit Financial will do the rest. Unlike a traditional bank loan, lawsuit funding is not a loan. Personal credit has no bearing on our funding decision, and you don’t need to be employed. Furthermore, there are no monthly payments. We are repaid only when the case successfully settles. If you don’t win your case, you don’t repay the cash advance – no strings attached.

Lawsuit Financial is one of the country's most experienced providers of litigation funding services. We work directly with your attorney to gather needed information to process your funding request quickly, typically within 48 hours. If you have been injured or lost a loved one due to a drunk driver, are in a pending lawsuit, and facing serious financial challenges while waiting for a settlement, contact Lawsuit Financial. If you do not have an attorney, we have a network of attorneys all over the country waiting to assist you. We would be happy to provide one in your area at no cost.

Lawsuit Funding: A No-Risk Financial Solution During A Pending Wrongful Death Lawsuit

A South Carolina woman is facing charges of driving under the influence resulting in death following a car-motorcycle accident. She has also been distribution of a controlled substance and driving too fast for conditions.

After someone dies in an auto crash, grieving family members are often left with many questions. What caused the accident? Could it have been avoided? What do they do now that their loved one is gone? Whiles sometimes auto accidents happen through no one's fault, often times they are due to negligence. In such cases, family members should pursue a wrongful death claim to uphold the victim's rights and begin the financial recovery process. A personal injury attorney can stand up for the rights of the family, but achieving maximum compensation can take time. Unfortunately, many victims are not in a financial position to wait out the litigation process because bills must be paid. If the plaintiff is unemployed or has poor credit, banks will usually not grant a loan. Even if approved for a bank loan, the victim would be required to make monthly payments and repayment would be required no matter the outcome of the case. Insurance companies know all this and won’t hesitate to pressure victims into accepting the lowest possible settlement. Before that happens, a better option would be lawsuit funding, a cash advance against the pending lawsuit.

A legal funding company understands the financial situation facing plaintiffs and knows the lengths that insurance companies will go through to reach a less-than-fair settlement offer. With a lawsuit cash advance, plaintiffs can level the playing field and push for justice. Funding is collateralized solely by the pending lawsuit. There are no upfront fees, no credit or employment checks and no monthly payments. Repayment of the cash advance is from the proceeds of the case, but if the plaintiff loses, the repayment is waived in its entirety.

If you or a loved one has been a victim of an auto accident caused by a negligent driver or your loved one was killed by a driver under the influence, consult a personal injury attorney who is knowledgeable and experienced in auto accidents. If you have mounting bills and expenses and feel the need to reach a quick settlement, stop! Apply for lawsuit funding with Lawsuit Financial to ease the financial burden and give your attorney time to obtain full value in your case. The application process is quick and easy, and can be done online. Once we determine if a case has merit and is approved for funding, you can have cash in hand within 24 - 48 hours. Contact us today for a free, no-obligation evaluation of your case.
