Teen Killed In Pedestrian-Auto Accident Blocks From School

Pedestrian accidents may be the most devastating of all automobile related accidents, because they involve at least one person on foot, unprotected by a vehicle, seat belts, and airbags. When a car collides with a pedestrian, there is an extremely high potential for serious injury, even death.

While the driver is often to blame when a pedestrian is hit by a vehicle, it isn't always the motorists' fault. Pedestrians can also cause accidents. Determining fault can sometimes be a complicated process. Did the driver run a red light? Was the driver speeding? Was the driver distracted? Did the pedestrian wander out into traffic while texting? Could either person have avoided the accident?

A 17-year-old Minnesota boy was struck and killed while crossing a county highway in Minnetonka, just blocks from school. The Minnesota State Patrol reported that around 6:20 a.m., a Nissan Munro traveling westbound hit the teen as he crossed the highway; he was not in a crosswalk or at an intersection when he was hit. The teen died at the scene. The driver and a passenger were not injured.

This tragedy is a good time to reiterate these pedestrian safety tips.
  • Cross the street only at intersections or marked crosswalks
  • Do not cross in the middle of a street or between cars
  • Continuously watch for traffic while crossing the street
  • Avoid walking on roads without sidewalks and crosswalks
  • Always look both ways before crossing the street – even if it is not a busy intersection
  • Do not assume that cars are driving slowly enough for you to cross or for them to stop
  • Do not run or dash into the street
The investigation is ongoing. If the motorist is determined to have been at least partially at fault, the family of the deceased teen may be able to file a wrongful death lawsuit. While a lawsuit may be the furthest thing from the family’s mind in the devastating aftermath, seeking legal counsel and determining one’s rights is crucial. A personal injury attorney can help determine who may be at fault, and decide the best course of action in recovering the maximum compensation for damages.

Unfortunately, the legal process can drag on for years. In order to wait for a fair settlement, yet avoid experiencing a shortfall in finances that could lead to a significant financial hardship, a plaintiff may benefit from litigation funding.

Litigation funding is a non-recourse cash advance meaning if the plaintiff loses his/her case, repayment is excused. The only eligibility requirements are attorney representation and a strong case. Applying for funding takes less than five minutes. There are no application fees, credit checks, employment history verifications, or monthly payments. Once we received the application and supporting documentation, a funding decision can be made within 24 – 48 hours.

If you are seriously injured or lose a loved one in a pedestrian-auto accident that was not your fault (or, was only partially your fault), you may be able to recover damages for medical bills, loss wages, pain and suffering, loss of companionship, loss of financial support, and funeral expenses. Contact a personal injury attorney who specializes in handling pedestrian accidents. After seeking legal representation, if you are in need help with your short-term financial needs, contact Lawsuit Financial.

Litigation Funding Fills a Need Caused by Settlement Delays

Are you a personal injury victim anxiously waiting for your case to settle, but need a cash to pay medical bills and basic living expenses? Financial needs and pressure can drive plaintiffs and attorneys to settle for less than they deserve. Ideally, you would be able to turn to credit cards or a bank loan. The problem with these options is that you are required to make monthly payments and even if your lawsuit is unsuccessful, you are still required to pay back your debt. You may be able to turn to family or friends, but what happens to the relationship if your case is lost and you can’t repay the money borrowed? One other alternative is litigation funding.
Litigation funding is a financial transaction where a plaintiff sells a portion of the future proceeds of his/her lawsuit in exchange for immediate cash. While a lawsuit cash advance can be a very valuable resource to someone who can’t get the money they need, it is more costly than other means and should only be used as a last resort.
Here are a few advantages of litigation funding:
  • Approvals based on strength of case only
  • No need for a credit check
  • No need for employment verification
  • No collateral required
  • No monthly payments; the cash advance is repaid from the proceeds of the case
  • Approvals typically within 24 – 48 hours
  • Money sent by wire transfer or overnight mail within 24 – 4 hours of approval
  • No risk. If your case is unsuccessful, you will never be required to pay us back
Don’t walk away from your case with anything less than the best settlement amount, and don’t spend months, or even years waiting for the money that you are entitled to for your pain and suffering. When you need litigation funding to meet financial obligations, Lawsuit Financial is here to help. Case we fund include, but are not limited to:
  • Auto accidents
  • Slip and fall cases
  • Medical malpractice cases
  • Pedestrian Accidents
  • Boating Accidents
  • Wrongful Death cases

Three College Students Struck By Drunk Driver, One Fatally Injured As They Walk Near Campus

Lawsuit Financial reports that one Skidmore College freshman was killed and two others critically injured when they were struck by a man later accused of drunk driving.

The three students were hit while walking near campus on Saturday evening. The young men were airlifted to area hospitals where one later died. Although the investigation is ongoing, the Saratoga County Sheriff's Office has charged the 64-year-old driver with first-degree vehicular assault and driving while intoxicated.
Cases like this can be devastating and complex in nature. Lawsuit Financial advises these victims and their families to contact an experience auto accident attorney immediately to protect their rights and get the compensation they deserve. For those needing assistance in locating an attorney, we would be happy to provide a free referral from our nationwide attorney database.

The time between filing a case and receiving a settlement can be financially devastating for most plaintiffs. Once an attorney has been hired and the case has been filed in court, plaintiffs are eligible for lawsuit funding. This emergency cash not only helps pay bills, but has the added benefit of keeping a case strong; the temptation to take an early, low settlement offer is gone.

Applying for lawsuit funding may be done online or over the phone. The process is easy, requiring no credit checks, employment verification, or monthly payments. Absolutely nothing is paid until the case is settled. Lawsuit Financial assumes all the risk, so if the case is lost, repayment is waived.

If you need emergency financial help to pay bills and stay on track until your case settles, contact Lawsuit Financial. If approved for funding, we can have cash in your hands within 24 – 48 hours. Attorney fought a “Frivolous Defense” for four years, but justice was served

A Brooklyn woman who suffered traumatic brain injuries after a hit-and-run accident has been awarded $22 million, the largest personal injury deal in state history. On her 32nd birthday in 2008, the woman was crossing a Manhattan street when she was struck by Duane Reade truck. She suffered brain damage, blindness and can hardly speak. Her injuries likely require her parents to take care of her for the rest of her life.

Her family filed a personal injury lawsuit against the pharmaceutical company claiming negligence on the part of their driver. Under the theory of vicarious liability, Duane Reade could be held legally responsible for its employee's negligence because the driver was on the clock working for the company at the time of the accident.

Duane Reade denied liability for years claiming the woman slipped on ice and fell under the rear wheel of the truck after it made a turn. The plaintiff’s attorney could not prove otherwise. The first trial ended in 2012 without a decision. It took another year before a second trial got underway. By this time, the plaintiff’s attorney was able to prove through witnesses and medical testimony that she was hit in the crosswalk by the front of the truck. Also revealed during the second trial was the truck’s drivers’ negligent, even malicious actions immediately after the accident. Instead of calling 911, the driver first called his union and bosses at Duane Reade. By early 2014, the defendant was willing to negotiate; both parties agreed to the $22 million settlement.

It took four years for justice to prevail because of a frivolous defense. Since the burden of proof is on the plaintiff in a civil case, the plaintiff’s attorney was forced to spend hours and hours of discovery, retaining experts, and preparing for trial. The victim was dragged through a legal impasse for years. This was done for no reason other than to prolong the litigation and make the plaintiff drop the case or be more desperate to settle for less.

The legal finance industry of which Lawsuit Financial is a part, was born out of frustration with conduct like just like this. A lawsuit cash advance can temporarily remove financial desperation, even the odds, and allow the plaintiff time to obtain an injury appropriate settlement. I don’t know whether this plaintiff sought a similar service, but it is available to all plaintiffs who fall victim to frivolous defense tactics.

If you have been seriously injured in an auto accident due to the negligence of someone else, have filed a personal injury lawsuit, and the case is dragging on longer than expected, you may benefit from lawsuit funding. There is no application fee, no monthly payments, and no credit checks or employment verification. Funds are provided based on the case-value only. Once approved, a check can be wired directly into the client’s bank account within 24 – 48 hours. This non-recourse cash advance is completely contingent upon the outcome of the case. Repayment is made once the case successfully settles, but if the case is lost, repayment is waived in its entirety.
