Lawsuit Funding Helps Personal Injury Claim Victims Seek Justice

Thousands of people suffer from a personal injury each year, and while you might want to imagine that it could never happen to you or someone you love, it can. The most common types of personal injury claims -- a means for an injured person to collect damages if he/she is injured by the actions or negligence or another person or entity -- are auto accidents, slip and falls, and defective products. When this is the case, you may be eligible to receive financial compensation in the form of a settlement.

Depending on the type and the severity of the injury, medical expenses can reach thousands of dollars or more, pain and suffering can last years and some injuries can put a victim out of work for life. Although you may have insurance to cover some medical expenses, it may not be enough.

Personal injury claims are designed to help victims seek compensation for medical expenses, pain and suffering, long or short term disabilities, but may also seek redress for emotional or psychological injuries. Even if the injuries incurred are minor and temporary, filing a personal injury claim may award substantial restitution, and in some cases, the victim may seek punitive damages. It is in your best interest to find an experienced attorney knowledgeable in your type of injury and who can help determine whether or not you should pursue your personal injury claim or lawsuit, and if so, your case value including medical expenses, lost wages, and pain and suffering.

Whether you file a claim or lawsuit, you will need to provide proof of medical expenses, missed days of work, medical records, police reports and anything else that proves the severity of your injuries. The insurance company uses this information to process a claim amount. A claim is between both involved parties and their insurance company, who will disperse the amount of money they feel your injury is worth. If, however, you feel your injuries are worth more than the settlement offer, you may choose to file a personal injury lawsuit.

Filing a personal injury lawsuit is not about greed, but justice and receiving fair compensation; it can also help prevent such negligence from being repeated. Unfortunately, many times these lawsuits will take months, even years to resolve. When injury victims feel forced, by financial circumstances, to consider settlements too early and for too little, they should contact Lawsuit Financial.

Lawsuit Financial knows about financial pressures from insurance companies and deep pocket defendants who have all the time and money in the world. Insurance companies and their attorneys are not injured, they are not missing work. Settlement or not, they can feed their families and take care of life's necessities. We can provide plaintiffs with lawsuit funding to take care of life's necessities (mortgage, rent, food, utilities, gas, car payments, medical expenses, transportation, etc) to reduce the financial pressures of an early settlement.

Lawsuit funding is not a “lawsuit loan.” There are not credit checks, employment verification, upfront fees or monthly payments, and it is not paid back, until the plaintiffs successfully settles. Should the plaintiff lose the case, we completely waive repayment of the cash advance. If the case qualifies, funding can be available within 24 hours.

If you have been seriously injured or lost a loved one in an auto accident, it is important to seek legal advice. Product Recalls And Lawsuit Funding

A dangerous or defective product is one that does not meet standards that we can reasonably expect. Sometimes manufacturers are aware of the fault but fail to recall them in time, some products are poorly designed or the result of a manufacturing flaw. Some manufacturers fail to carry out adequate checks. When situations like this occur, they often lead to serious personal injuries or deaths.
Several recalls were announced last week, including two expansions on prior recalls.\
Dräger Medical expanded a prior recall on ventilators used in hospitals as well as during patient transport. The Evita V500 Ventilator provides constant breathing support for adults and children, including premature babies weighing at least 14 ounces. The Babylog VN500 provides constant breathing support for premature babies weighing at least 14 ounces. Both ventilators are used in hospitals or during patient transport. In December 2015, Dräger recalled the PS500 battery power supply because a software issue causes shorter than expected battery run times. It also prevents the appropriate alarm from sounding 5 minutes before the battery runs out of power and the device shuts down. If the ventilator shuts down, a patient may not receive necessary oxygen which could cause patient injury or death. The FDA classified it as a Class I recall, the most serious type of recall. Last week the company expanded the recall to include the PS500 Optional Power Supply units that were updated with new software as part of the December recall. The company updated its software to elongate the battery life of the ventilators, but the new software did not fix the problem. Dräger Medical will now replace all affected PS500 power supply units. The recall affects 2,501 units across the U.S.
Toyota announced it is adding the 2008 Toyota Corolla, 2008 Toyota Matrix (also called the Toyota Corolla Matrix), and the 2008-2010 Lexus SC430 to its list of recalled models due to involvement of Takata airbags. An additional 198,000 vehicles were pulled this week.
Manufacturers and retailers are responsible for taking reasonable steps to make sure that the products they make and sell are as safe as possible. When an unsafe product causes serious harm or death, a “products liability” suit may be appropriate. This area of litigation is specialized, and can take years to settle. In order to secure damages, an attorney must prove that the product contained inherent design defects, was badly manufactured or assembled, or built in such a way that safety features could fail or be dismantled. Manufacturers can also be held liable for failure to warn consumers of potential harm from the product’s intended use or likely use. In the meantime, manufacturers and retailers will go to great lengths to defend their products, even when the dangers they caused are undeniable and could easily have been avoided.
If you have been injured or lost a loved one due to a dangerous or defective product, consult an attorney immediately. If you are unable to work, bills are piling up, and important financial obligations are being neglected because you don’t have the resources needed, contact Lawsuit Financial. Cutting Corners, Risking Lives

Consumer products touch nearly every aspect of our daily lives — whether at home, work, school, on our roadways, or at leisure. We use these products giving little thought as to the risks they may pose.  Unfortunately, thousands of consumers are injured by defective or faulty products – vehicles, children’s toys, baby products, household products every year; the results are often serious, sometimes deadly.  Although the company may not have intentionally manufactured and/or marketed a product that has harmed someone, the company may have:
  • failed to do everything in its power to safely manufacture the product.
  • failed to warn consumers about potential dangers.
  • failed to label the product appropriately.
  • rushed a product to market as soon as possible at the expense of safety.
When an individual sustains an injury from a defective product, s/he has a legal right to compensation for medical expenses, loss of income, other out-of-pocket expense, and pain and suffering as a result of the injury.

Defective product lawsuits are extraordinarily complex and difficult to settle.   Manufacturers have deep pockets to hire the best attorneys. As the plaintiff, you have the burden of proof to convince the court not only that the product was defective or dangerous, but also that the defect caused your injury.  An experienced attorney can help determine your rights and what recourse, if any, is available to you.

It would be nice if all manufacturers always manufactured and marketed safe products. It would be nice if corners weren't cut to increase profits. It would be nice if all manufacturers put people and safety over profits. When they don’t and someone is seriously injured or dies, a lawsuit can not only hold the negligent company accountable, it can also serve as a powerful tool for prevention, as well intervention, particularly where product regulation is absent or has failed to achieve an adequate level of safety.

When corporations don’t do the right thing, Lawsuit Financial will continue to provide non-recourse lawsuit funding to injured people who are fighting these corporate Goliaths without adequate resources to do so.  We provide lawsuit cash advances without upfront fees and monthly payments. In fact, there are no payments until you win your case; if you lose the repayment is waived.  Hopefully, our legal finance services will provide the resources to withstand the litigation process until justice is served.  Call us today to learn how we may be able to help you during your pending claim.  You could have cash in hand in as little as 24 hours.
