Dangerous
road cases are difficult and expensive. The government bodies controlling the
roads have strong defenses put in place by the government itself. Proving a dangerous
roadway caused an auto accident can be a long legal process and difficult to
prove. This is on top of the expenses a family may already be facing due to the
injuries sustained. Even if the injuries or death did not result in loss of
income, plaintiffs may struggle to make ends meet. Lawsuit Financial understands that
auto accident lawsuits can be hard fought and take months, even years to
settle. We also understand that plaintiffs may struggle financially waiting for
their case to settle. Lawsuit Financial is a strategic lawsuit funding company that may be
able to provide the financial support you and your family need while awaiting a
settlement or other resolution to your case.
The
Utah Supreme Court has
reinstated a wrongful death lawsuit filed against UDOT by the parents of a 15-year-old
girl who died in 2011 after a state road collapsed. The teen was killed after the
Ford Excursion she was riding in struck an upthrust piece of asphalt where the
road had given way. The velocity of the SUV carried it over the hole, and it
crashed on the far side. Her father, the driver of the vehicle, sustained serious
injuries in the accident. Another vehicle, travelling in the opposite
direction, had already driven into the hole, landing with its front bumper in
the hole and its back end pointing straight in the air. That driver also
suffered serious injuries. The Utah Highway Patrol (UTP) said heavy rainfall
and a clogged culvert triggered the collapse, creating a hole in the roadway 40
feet wide and 30 to 40 feet deep.
In
their wrongful death lawsuit, parents of the teen alleged negligence by UDOT
caused the road to collapse. The suit stated earlier in that day, UDOT employees were working in the area where
a blocked culvert had caused a temporary lake. Yet, despite efforts to remedy
the situation, work was discontinued without any warning to drivers of the
dangerous conditions. "UDOT
knew or should have known that the buildup of water, and the associated
saturation of the underlying fill, created a risk that the road would
collapse," the lawsuit states.
In
March 2013, a district court judge ruled that UDOT was immune from the lawsuit
under the state’s Governmental Immunity Act which bars lawsuits in cases where
someone is hurt as a result of the operation of a storm water system or a state
agency's management of flood waters. In reversing the decision, the Supreme
Court ruled that, while the blocked culvert might be part of a larger storm
water system, it could not be considered a storm water system on its own, as
attorneys for UDOT have argued. The Supreme Court's ruling means the case is
now likely headed to trial.
In
a case like this, Lawsuit Financial may be able to provide the financial
support needed while awaiting a settlement or other resolution in the case. We evaluate
cases and if approved, can often wire funds within 24 – 48 hours. Lawsuit funding
is immediate cash without credit checks, employment verifications or monthly
payments. Unlike a traditional bank loan funding is based solely on the merits
of the case. With some of the bills paid - medical expenses, funeral and burial
expenses, daily household expenses - plaintiffs can focus on healing and avoid
settling for less than full case value. Unlike a bank loan that must be paid
back no matter the end results, lawsuit funding is only repaid when the case
successfully settles. If the case is lost, repayment of the cash advance is completely
waived.
