The Utah Supreme Court has reinstated a wrongful death lawsuit filed against UDOT by the parents of a 15-year-old girl who died in 2011 after a state road collapsed. The teen was killed after the Ford Excursion she was riding in struck an upthrust piece of asphalt where the road had given way. The suit stated earlier in that day, UDOT employees were working in the area where a blocked culvert had caused a temporary lake. "UDOT knew or should have known that the buildup of water, and the associated saturation of the underlying fill, created a risk that the road would collapse," the lawsuit states.

In March 2013, a district court judge ruled that UDOT was immune from the lawsuit under the state’s Governmental Immunity Act which bars lawsuits in cases where someone is hurt as a result of the operation of a storm water system or a state agency's management of flood waters. In reversing the decision, the Supreme Court ruled that, while the blocked culvert might be part of a larger storm water system, it could not be considered a storm water system on its own, as attorneys for UDOT have argued. The Supreme Court's ruling means the case is now likely headed to trial.
